Nanda Nexus-Returns, Cancellations and Refunds

Applies to: All purchases of EATSOME branded products via the official online platform or authorised distributors within Australia.

1. Purpose and Commitment

At Nanda Nexus, we are committed to conducting business transparently and in accordance with the Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth).

This Policy sets out your rights and our obligations with respect to returns, replacements, and refunds, while protecting against misuse or unreasonable claims.

2. No Refund for Change of Mind or Taste

All orders placed with Nanda Nexus are final.

Once an order has been dispatched, it cannot be altered, cancelled, or refunded.

We do not provide refunds, returns, or replacements in the following cases:

Change of mind or personal preference;

Dislike of flavour, texture, or taste;

Incorrect product selection or misunderstanding of description;

Finding the same product cheaper elsewhere;

Products sold within their marked best-before date;

Expiry concerns arising after dispatch.

All purchases are made at the consumer’s discretion and responsibility.

3. Major Faults or Damaged Products

In line with the Australian Consumer Law, you are entitled to a remedy if a product has a major problem, such as:

Being unsafe for consumption;

Being significantly different from its description; or

Being unfit for its intended use and cannot be remedied within a reasonable time.

If your Eatsome product meets these conditions, you may be eligible for a replacement of the same or equivalent item.

Refunds are not offered unless required by law and replacement is not reasonably possible.

4. Evidence and Claim Requirements

To be eligible for a replacement, you must:

Notify Nanda Nexus within 48 hours of receiving your order; and

Provide clear video evidence showing the unopened container and packaging condition at the time of delivery; and

Provide proof of purchase (invoice, order confirmation, or receipt); and

Retain the product in its original, unconsumed condition until the claim is assessed.

Claims submitted after 48 hours of delivery or without required evidence will not be processed under any circumstances.

This ensures product integrity and fair assessment.

5. Assessment and Remedies

Upon receiving your claim, Nanda Nexus will:

Review the submitted evidence;

Conduct an internal quality inspection or request return for verification; and

If the claim is approved, issue a replacement of the same or equivalent product.

We do not provide cash, card, or store-credit refunds.

Our remedy obligation is limited to replacement only.

6. Exclusions from Returns, Refunds, and Replacements

No return, refund, or replacement will be accepted for:

Claims made after 48 hours of delivery;

Products damaged after delivery due to improper handling, storage, or use;

Opened, consumed, tampered, or repackaged products;

Items purchased from third-party stores, grocery outlets, or trade shows (these are subject to their own return policies);

Products purchased during sales, promotions, or trade fairs;

Issues arising from taste, appearance, or packaging differences not affecting quality.

7. Products Purchased via Retail Stores or Trade Shows

If you purchased Eatsome products through a local grocery store, supermarket, convenience store, or trade fair, your return or refund rights are governed by that retailer’s policy.

Nanda Nexus does not process returns or replacements for products sold through independent distributors, retail chains, or event stalls.

8. Minor Product Issues

For minor issues (such as small dents in packaging or labelling variations) that do not impact safety or usability, Nanda Nexus may, at its sole discretion, offer a goodwill replacement.

However, such issues do not entitle you to a refund under ACL provisions.

9. Shipping and Delivery Responsibility

Risk of loss or damage passes to the customer upon dispatch.

Nanda Nexus is not liable for:

Courier or postal delays;

Damage occurring during transport;

Incorrect or incomplete delivery addresses provided by the customer;

Temperature-related spoilage or storage issues after delivery.

10. Limitation of Liability

To the fullest extent permitted by Australian law:

Nanda Nexus’s liability is limited strictly to replacement of defective goods;

We are not responsible for indirect loss, inconvenience, or dissatisfaction;

All Eatsome products are consumed at the consumer’s own risk and discretion;

Nanda Nexus shall not be held liable for any allergic reactions, health issues, or adverse outcomes resulting from consumption of its products, as all ingredients are disclosed clearly on the packaging.

11. Governing Framework

This Policy is governed by the laws of Australia under the Competition and Consumer Act 2010 (Cth).

Nanda Nexus will handle all claims internally in compliance with ACL obligations.

Consumers agree to resolve any issues directly with Nanda Nexus as per this Policy.
